As of July 1, 2021, Virginia law permits adults aged 21 and over to cultivate cannabis at home for personal use, with the following stipulations:

  • Plant Limit: Up to 4 cannabis plants per household, regardless of the number of adults residing there
  • Location: Cultivation must occur at the individual's primary residence
  • Visibility: Plants must not be visible from a public space, such as streets or sidewalks
  • Access: Cultivated plants must in inaccessible to individuals under 21 years old
  • Labeling: Each plant must have a legible tag that includes:
    • The grower's name
    • The grower's driver's license or ID number
    • A note indicating the plant is being grown for personal use as authorized by law
  • Concentrate Production: Manufacturing cannabis concentrate from home-cultivated cannabis is prohibited.
NOTE: While home cultivation is legal, retail sales of recreational marijuana remains prohibited in Virginia and in all states throughout the US.
